1 - Conditions

CONDITIONS

The terms and conditions indicated below (the "General Conditions of Sale") form an integral part of the contracts concluded between the Seller and the Buyer for the supply of the Seller's products (the "Products"). The General Conditions of Sale apply to all transactions concluded between the Seller and the Buyer, therefore to those by correspondence (website, email, post or fax), retail in stores, retail, wholesale or by contract special, without the need for an express reference to them or a specific agreement to that effect at the conclusion of each individual transaction. Any different conditions or terms apply only if confirmed in writing by the Seller. 

2 - Contracts

TRADING

They are understood to be concluded except for the sale and unless the price changes when the order is sent by the buyer.

3 - Shipping risks

SHIPPING RISKS

Changes to orders made verbally or by telephone must be confirmed in writing by the Buyer. Otherwise, the Seller assumes no responsibility for any errors or possible misunderstandings. The seller is not responsible for errors / errors caused by insufficient, incorrect and / or incomplete address provided by the buyer. The goods travel at the buyer's risk and peril and claims for delays, failures and losses deriving from transport are not accepted, even if the goods are carriage paid; these complaints must be made to the courier before collecting the goods. The Seller reserves the right to reasonably make partial deliveries. Any liability for delivery resulting from force majeure or other unforeseeable events not attributable to the Seller,

4 - Payments

PAYMENTS

The purchased goods are normally sent by courier and can be paid in advance for cash up to a maximum of € 3,000.00 or to the maximum extent permitted by law on the date of execution or by electronic means (bank transfer; paypal; credit card ). For shipments of packages, plants and bulky items weighing more than kg. 30, only advance payment is allowed.

Credit card

We accept most popular credit cards, except American Express.

PayPal

PayPal is an online payment system that provides for the opening of an account with PayPal or the use of a credit card. By choosing this method, after clicking "send order", you are redirected to a page on the PayPal site where you can enter your Paypal account e-mail and password, in order to pay for the order. For each transaction made with this method, a confirmation email is sent from PayPal. The order amount is debited to the PayPal account at the time of the order acquisition. In case of cancellation the amount is refunded to the customer's PayPal account. In case of missing product, a voucher valid for 18 months will be generated. For telephone, fax and email orders you can pay the amount of the order on PayPal at aziendaadaleo@gmail.com

Bank transfer

In case of payment by advance bank transfer, the order will be managed only after receiving confirmation of the credit from the bank. The reason for the bank transfer must necessarily include the order number and name and surname of the customer. 

The transfer must be made within 7 days and made payable to:

Postpay

In case of Payment with Postpay, select the appropriate section in the payment. The order will be managed after payment and receipt of the same. To speed up the order, send a copy of the receipt to the email address info@passiflorashop.com

The postpay data will be provided after selecting the payment with "Postpay"

Invoices

The data for the invoice will be requested at checkout; choosing "Invoice" the fields where you can enter your tax information appear

ATTENTION - FOR VAT HOLDERS - FROM 1 JANUARY 2019 it will not be possible to issue an invoice if the "Email PEC or Identification Code" field is not filled in. Orders received without filling in this field will be processed WITHOUT an invoice

5 - Complaints

COMPLAINTS

The goods must be checked upon receipt. Written complaints are accepted only by fax, PEC e-mail, A / R mail only within three days following receipt of the goods. Attach a photo to the complaint.

6 - Right of withdrawal

RIGHT OF WITHDRAWAL

The customer's rights are protected by Legislative Decree 206/2005 as amended. The Customer therefore has the right to withdraw from the contract, even partially, without explanations and without increasing costs with the express exclusion of those for returning the goods, provided that the withdrawal is communicated by registered letter with return receipt or PEC email to the addresses provided by the assistance, within 14 working days from the day of receipt of the products. The communication can be anticipated, within the same term, by e-mail (at info@passiflorashop.com), provided that it is confirmed by registered letter within the next 48 hours. This communication must specify the intention to withdraw from the purchase and the product or products for which you intend to exercise the right of withdrawal, attaching a copy of the transport document. The Customer must therefore return the product to Passiflorashop at his own expense to the address provided by the assistance. If the withdrawal has been exercised in the manner described, Passiflorashop will refund the amount paid for the purchase of the product within 14 days from the date on which Passiflorashop became aware, in the forms indicated above, of the exercise of the right of withdrawal by the customer. The refunded amount will include delivery costs. For purchases made with one of the following payment methods: - cash on delivery (cash on delivery) - bank transfer Passiflorashop will proceed with the refund by bank transfer. For purchases made by payment by Credit Card or Paypal, the refund will be made by reversing the transaction directly on the Credit Card or on the Paypal account. The seller reserves the right to make the refund also in the form of a purchase voucher of equivalent value to that referred to in the withdrawal exercised by the buyer. In the event that the withdrawal is partial, the delivery costs will be refunded to the customer in proportion to the value of the returned goods.

The Customer will be responsible for the decrease in value of the returned good resulting from a manipulation other than that necessary to establish the nature, characteristics and functioning of the good itself.

Without prejudice to the above, given the particular nature of the products marketed by the seller, the right of withdrawal is not allowed in the case of:

• sealed packaged products that are opened by the customer;

• goods which by their nature cannot be returned as they are subject to rapid deterioration and alteration (by way of example but not limited to all plants and flower bulbs).

7 - Product guarantees

GUARANTEES

Plant guarantees

The engraftment of plants, depending on important and multiple factors unrelated to the vitality of the plants themselves at the time of their shipment, cannot in any case be guaranteed. Since an involuntary error of labeling or mixing in the preparation of the packages is always possible, the seller declines any responsibility for the authenticity of the variety.

Seed guarantees

The seller pays all the utmost care and caution in selecting the seeds marketed by him and this in order to provide his customers with the best quality and variety of products. The company, founded in 1817, has constantly improved the quality of its products so as to create a solid national and international reputation. It has technicians of unquestionable ability, staff in charge of assiduous care and surveillance of crops and relies on the most renowned analysis laboratories for the control of its products. Nonetheless, the House must bring to the attention of the Customers: a) that every operation, from the harvest to the threshing, from the mechanical selection to the storage of the seeds in the warehouses, from their picking to the packaging in gr. 1 and beyond, it is entrusted to workers. Through these multiple passages of the goods, the possibility of a labeling error, a mixture of varieties, an incorrect picking cannot be admitted; b) that for some varieties it is sourced from primary foreign firms; c) that a fortuitous, unpredictable hybridization can change the characteristics of some varieties; d) that the possibility of willful misconduct or sabotage by persons employed by it cannot be excluded a priori. As a consequence of the foregoing, Passiflorashop is unable to offer any guarantee for the articles it markets. It limits its guarantees to the mechanical purity and germinability of its products in accordance with the terms and methods of the law. Recognized in the ways prescribed by law a lower degree of mechanical purity or germinability,

8 - Transportation

TRANSPORT

Shipping costs are always charged to the Customer and vary according to the weight of the goods. The amount will be communicated in advance upon completion of the purchase.

9 - Jurisdiction

JURISDICTION

For any dispute that may arise regarding the interpretation and execution of the sales contract, the parties expressly acknowledge the exclusive and mandatory competence of the Court of Palermo.

The invalidity in whole or in part of single provisions of these General Conditions of Sale does not affect the validity of the remaining provisions.
